User agreement (public offer agreement)

This Agreement defines the terms of use of the materials and services of the website https://kozaksembassy.com/ (hereinafter referred to as the “Website”) by Users.

All titles/ranks are symbolic in nature; they are a token of honour and do not grant any legal privileges.

1. General Provisions

1.1. This Agreement is a public offer in accordance with the legislation of Ukraine. By accessing the materials of the Website, the User accepts the terms of this offer (acceptance).

1.2. The moment of conclusion of the contract is the User’s registration on the Website or payment for an order.

2. Terms and Definitions

2.1. “Seller” — the administration of the Website that sells goods or provides services.

2.2. “Buyer” — a person who accepts the terms of the Agreement and uses the services or goods of the Website.

2.3. “Website” — the web resource https://kozaksembassy.com/.

2.4. Other terms may be defined in the relevant sections or documents (Privacy Policy).

3. Rights and Obligations of the Parties

3.1. The Seller has the right to make changes to this Agreement. Such changes take effect from the moment they are published on the Website and apply to orders placed after such publication. Orders placed before the changes take effect are governed by the terms in force at the time the order was placed.

3.2. The Seller undertakes to provide goods or services of proper quality within the established timeframes.

3.3. The Buyer is obliged to provide correct contact details and to pay for the order in accordance with the terms of the contract.

3.4. The Buyer is obliged to independently review the current content of this Agreement, posted at kozaksembassy.com/oferta.

4. Prices and Payment Procedure

4.1. Prices for goods and services are shown on the Website and may be changed by the Seller. The price in effect at the time the order is placed applies to that order.

4.2. Payment for an order is made using one of the methods available on the Website: online payment by bank card via the LiqPay service (full prepayment), or payment on delivery (cash on delivery) at a branch of the postal operator “Nova Poshta”.

4.3. The Buyer selects the payment method when placing the order. In the case of online payment, the order is processed after the full payment is received; in the case of payment on delivery, after the order is confirmed by the Buyer.

5. Delivery and Transfer of Goods/Services

5.1. Delivery methods are determined when placing the order. Delivery is carried out according to the rates and timeframes of the postal operator “Nova Poshta”.

5.2. The Buyer is obliged to check the completeness of the goods upon receipt.

6. Warranties and Liability

6.1. The Seller guarantees that the goods and services conform to the description on the Website.

6.2. The Buyer has the right to make a claim in the event of non-conformity of the goods or services.

6.3. The Seller is not liable for losses arising from the improper use of goods or services.

6.4. The use of the Website’s materials without the consent of the rights holders is not permitted (Articles 440–443 of the Civil Code of Ukraine). The lawful use of the Website’s materials requires the conclusion of licence agreements (obtaining licences) from the rights holders.

7. Procedure for Returning Goods and Funds

7.1. Return of goods of improper quality. The online store guarantees the refund of funds paid by the Buyer for purchased goods in the event of their improper quality. Goods of improper quality may be returned or replaced with an equivalent product of proper quality, or the funds paid for the goods will be refunded to the Buyer. A return is possible within 14 (fourteen) calendar days from the moment the Buyer receives the goods, if the goods do not meet the requirements stated in the product description on the Website or have defects that did not arise from improper use.

7.2. Return of goods of proper quality. Since the goods are individual (custom) orders, they are not subject to return or exchange in accordance with the legislation of Ukraine. Goods of proper quality are not returnable, as each product is manufactured or adapted specifically for each Buyer. Please check all order details carefully before confirming your order.

7.3. Return procedure. To return goods of improper quality, the Buyer has the right to contact the Seller using the contact information on the Website and submit a corresponding claim. When returning goods of improper quality, the Buyer is obliged to provide all documents confirming the fact of purchase and receipt of the goods. The Seller reviews the claim within 14 (fourteen) calendar days from the moment it is received.

7.4. Refund procedure. A refund for goods of improper quality is made within 14 (fourteen) calendar days from the moment the Seller receives the goods, provided that the Buyer complies with the requirements for returning goods of improper quality. The costs associated with the return of goods of improper quality are borne by the Seller.

7.5. Replacement of goods. Goods of improper quality may be replaced with goods of proper quality, or the funds refunded to the Buyer. Replacement of goods or a refund takes place within 14 (fourteen) calendar days from the moment the Seller receives the goods.

7.6. Refusal of goods. The Buyer has the right to refuse the goods upon receipt if the goods do not comply with the terms of this Agreement or have defects that were not stated in the product description.

7.7. Refunds for cashless payments. In the case of a cashless payment, the Seller refunds the funds to the Buyer’s bank card from which the payment was made, or to another card specified by the Buyer. The refund is made no later than 14 (fourteen) calendar days from the moment the Seller receives the goods.

7.8. Refusal to accept a return. The Seller has the right to refuse to accept a return if the Buyer has violated the return terms set out in this offer or in accordance with the applicable legislation of Ukraine.

8. Confidentiality and Protection of Personal Data

8.1. The Seller undertakes to maintain the confidentiality of the Buyer’s personal data.

8.2. Detailed information on data protection is contained in the Privacy Policy.

9. Force Majeure

9.1. The Parties are released from liability for failure to fulfil their obligations in the event of force majeure circumstances (natural disasters, military actions, etc.).

10. Term of the Contract

10.1. This Agreement is valid until the Parties have fully fulfilled their obligations or for an indefinite term.

10.2. The Seller has the right to terminate the contract in the event of a violation by the Buyer of the terms of the Agreement.

11. Dispute Resolution

11.1. All disputes are resolved through negotiations. If resolution is not possible — in accordance with the legislation of Ukraine.

13. Final Provisions

13.1. The Seller has the right to make changes to the Agreement, notifying the Buyers thereof.

13.2. An Agreement concluded in electronic form has legal force.

13.3. The User’s comments and other entries on the Website must not conflict with the requirements of the legislation of Ukraine or with generally accepted moral norms.

The User confirms that they have read all the provisions of this Agreement and unconditionally accept them.
